General Terms and Conditions of Sale (GTC) - NKOSI. (nkosiagro.com)

 

ARTICLE 1 – Scope of application

These General Terms and Conditions of Sale (GTC) govern the contractual relations between the company NKOSI AGRO, SASU with share capital of €1,000, registered with the Paris Trade and Companies Register under number 922 273 784, and any private or professional customer wishing to purchase the products offered on our website nkosiagro.com.

By placing an order on our website, the customer unreservedly accepts these General Terms and Conditions. These terms and conditions prevail over any other document, unless otherwise agreed in writing.

 

ARTICLE 2 – Products

We offer exotic food products (dried, fresh, and frozen). The descriptions, photos, and information on this website are provided with the greatest possible accuracy. However, minor variations may occur.

Products are sold while stocks last. If the product is unavailable after the order has been confirmed, we will inform the customer and offer a refund or alternative.

 

ARTICLE 3 – Orders

• Any order placed on nkosiagro.com constitutes a distance contract between the customer and NKOSI AGRO.
• The order is confirmed after receipt of full payment.
• The customer must verify the accuracy of the information provided (address, products, etc.) before validation. NKOSI AGRO cannot be held responsible for any errors attributable to the customer.

 

ARTICLE 4 – Price and payment

• Prices displayed are in euros (€), all taxes included. They do not include delivery charges, which are calculated before order confirmation.
• NKOSI AGRO reserves the right to modify its prices at any time. The applicable prices are those in effect at the time of the order.
• Payments must be made online by credit card or through the payment options offered on our website. The order will be shipped after full payment has been received.

 

ARTICLE 5 – Delivery

Delivery areas:

• Dry products  : Delivery in mainland France and internationally.
• Fresh and frozen products  : Delivery only to France, Belgium and Luxembourg.

Time limit :

• Dry goods: 2 to 5 working days in France; up to 10 working days internationally.
• Fresh and frozen products: Delivery within 24 to 48 hours.

Terms :

• Shipping costs vary depending on weight, geographic area, and the method chosen. They are displayed before confirming the order.
• The cold chain is guaranteed for fresh and frozen products. These products must be received immediately to avoid any deterioration.

 

ARTICLE 6 – Withdrawal and returns

In accordance with legal provisions, the customer has a right of withdrawal of 14 days  for unopened dry goods in perfect condition. This right does not apply to fresh and frozen products for health reasons.

Fresh and frozen products:

• No returns are accepted for these products.
• In the event of a proven error or anomaly (non-compliant, damaged product or break in the cold chain), a full or partial refund will be offered after verification by our teams.

The cost of returning dry products remains the responsibility of the customer, except in the event of an error attributable to NKOSI AGRO.

 

ARTICLE 7 – Guarantees

All our products benefit from legal guarantees:

• Legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code).
• Guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

In case of any problem, the customer must contact us within a maximum of one month after receiving the product.

 

ARTICLE 8 – Liability

NKOSI AGRO cannot be held liable for damages resulting from misuse of the products or improper storage by the customer. Our liability is strictly limited to the total amount paid for the order.  concerned.

 

ARTICLE 9 – Personal data

We collect and use your personal data in accordance with our privacy policy available at nkosiagro.com. This data is necessary to process your orders and improve our services.

 

ARTICLE 10 – Applicable law and disputes

These General Terms and Conditions are subject to French law. In the event of a dispute not resolved amicably, the competent courts will be those of the registered office of NKOSI AGRO.
